Agreement

By using Eminder you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the app.

The service

Eminder is an iPhone app for notes, tasks, schedules and studying. The free version includes notes, tasks, folders, your own decks and every study mode. Eminder Pro adds cloud AI features. We may improve, change or remove features over time.

Accounts

• You must be at least 13 to use Eminder, and old enough to agree to these terms where you live, or have a parent's or guardian's permission.
• Keep your sign-in secure. You are responsible for what happens on your account.
• One account per person. Don't impersonate anyone or pick a misleading username.

Eminder Pro

• Where to buy. Pro is sold on the web through Stripe. The price and any taxes are shown at checkout before you pay.
• Renewal. Subscriptions renew automatically at the end of each period until you cancel.
• Cancelling. Cancel anytime from the Manage subscription link in Eminder, or from the link in your Stripe receipt email. Pro stays on until the end of the period you already paid for.
• The 7 day pass is a one-time purchase. It does not renew.
• Refunds. Email support@nxtimaginelabs.com. We review every request, and we always honor refund rights the law gives you.
• Price changes. We will tell you before a new price applies to your subscription. You can cancel before it does.
• Your account. Pro belongs to the account you bought it with. Sign in with that account on any iPhone to use it.

Fair use of AI

AI features cost real money to run, so Pro includes a generous monthly AI limit that resets each month. There are also short-term rate limits. Automated, bulk or shared use of AI features is not allowed, and neither is reselling them. We may pause AI access on an account that abuses them.

Your content

Your notes, decks, recordings and files are yours. You give us permission to store, process and transmit them only as needed to run the features you use, for example sending material to an AI provider when you ask for flashcards, or showing a deck you publish in Community. That permission ends when you delete the content or your account, except for copies other people already saved from Community. Only share content you have the right to share.

Community rules

Community is for sharing study decks. We have zero tolerance for objectionable content and abusive users. Do not post or send:

• hate speech, or attacks on people for who they are,
• harassment, bullying or threats,
• sexual content,
• violent or graphic content,
• spam, scams or advertising,
• material that infringes someone's copyright or other rights,
• other people's private information.

You can report any deck or comment and block any user. We review reported content within 24 hours. We remove content that breaks these rules and remove the accounts that posted it. We may remove any content or account at our discretion. Read the short version in our Community guidelines.

Using Eminder properly

Don't break the law with Eminder, interfere with the service, try to get around limits or security, access other people's data, scrape Community, or reverse engineer the app except where the law allows it.

AI results

AI can be wrong. Check results before you rely on them. They are study help, not professional advice. You are responsible for following your school's rules on using AI.

Apple

If you downloaded Eminder from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. These terms are between you and Nxt Imagine Labs, not Apple. Apple is not responsible for Eminder or its support.

Ending your use

You can stop using Eminder and delete your account at any time from Settings in the app. We may suspend or close accounts that break these terms. Deleting your account cancels any web subscription.

Disclaimers

Eminder is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including that the app will be error-free or always available. Reminders and alarms depend on your iPhone's settings, so don't rely on Eminder alone for anything critical.

Limitation of liability

To the extent the law allows, Nxt Imagine Labs is not liable for indirect, incidental, special or consequential damages, or for lost data, grades or profits. Our total liability for any claim is limited to the amount you paid us for Pro in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.

Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute that can't be settled informally goes to the state courts in Queens County, New York, or the federal courts for the Eastern District of New York, and you and we agree to their jurisdiction. Nothing here limits rights you have under the consumer laws of the place you live.

Changes

We may update these terms. We will post the new version here with a new date, and tell you in the app if a change is significant. Using Eminder after a change means you accept it.
